How do class action lawsuits work?

Class action claims work differently than traditional lawsuits. One of the main differentiators is that rather than a single plaintiff, there are multiple plaintiffs in a class action lawsuit.

This allows people who have been injured by the same product or company to join forces and pool resources. It also means that the potential damages awarded in a class action lawsuit can be much higher than in an individual lawsuit.

Another key difference is that class action lawsuits are filed in federal court, while individual lawsuits are usually filed in state court.

The class action process starts with injured parties asking for their complaint to be certified as a class action.

If the judge presiding over the case approves the class action certification, then all potential class members are notified of the lawsuit and given an opportunity to opt-in or opt-out of the action.

If they choose to opt-out, they can still file their own individual lawsuits.

If they choose to opt-in, they become part of the class action and their claims will be decided along with everyone else’s in the lawsuit.

Once class members have been notified, the class action proceeds like any other lawsuit. The parties exchange information and documents, conduct depositions and engage in pretrial motions.

If the case does not settle, it will go to trial. At trial, the class representative presents the class’s claims to a judge or jury, who will then decide if the plaintiffs are entitled to damages and, if so, how much.

The class representative presents the class’s claims

After trial, the court will issue a final judgment that awards damages to the class members.

Depending on the nature of the case, class members may then have to submit proof of their damages in order to receive a payment from the class action settlement fund.

How can a class action lawsuit help me?

If you’ve been injured by a defective product or pharmaceutical drug, filing a class action lawsuit can provide you with a number of benefits.

First and foremost, it can help you recover the compensation you deserve for your injuries.

Additionally, class action lawsuits send a message to companies that they cannot get away with putting profits over people, and they can help protect others from being injured in the future by forcing companies to change their practices.

If you’ve been injured by a defective product or pharmaceutical drug, the class action lawyers at NGK Law can help you understand your legal options and decide if filing a class action lawsuit is right for you.
