Missouri Police Misconduct Attorneys – Free Consultation
Law enforcement officers have a responsibility to uphold our civil rights as they uphold the law. However, we see almost daily examples of police officers failing to do so. From shootings to excessive use of force, sexual assault and jail neglect, police misconduct is far too commonplace in today’s world.
In fact, one of the most notorious examples of police brutality happened right here in Missouri in 2014, when Michael Brown was brutally gunned down by a police officer in the St. Louis suburb of Ferguson.

How common are police officer-involved shootings in Missouri?
Police shootings are, unfortunately, all too common in the state of Missouri. Since 2015, there have been at least 203 police shootings in the state, according to the Washington Post.
Of those shootings, many were fatal. In many of these cases, the person who was shot was unarmed.
Lawmakers understand that police officers have a dangerous job, so they are given a great amount of leeway to uphold the law. However, if a law enforcement officer uses force, it must be comparable to the amount of force that anyone would use in a similar situation.
If you or someone you love has been victimized in an excessive force situation, you can seek justice by filing a lawsuit under Section 1983 of the United States Code.
How do Section 1983 lawsuits work?
Section 1983 lawsuits are civil rights claims that allow individuals to sue state actors, including police and corrections officers, for violating their rights.
To win a Section 1983 lawsuit, the victim must prove that the officer acted willfully and deprived them of their rights under the United States Constitution.
Courts can award both monetary damages as well as punitive damages in these cases. Monetary damages are meant to compensate the victim for their losses, while punitive damages are meant to punish the officer for their misconduct and deter future misconduct.
There is a statute of limitations in Section 1983 claims, but it can vary depending on the type of violation. This is often, but not always, a personal injury case, which puts the statute of limitations at three years.
